Judge rapporteur Zigann referred Xiaomi’s request to stay the proceedings to the full panel for decision. Xiaomi requested that the proceedings be stayed until the UK High Court of Justice has decided on the final terms of a FRAND license agreement in parallel proceedings.
“The management of options to stay the proceedings in the context of a parallel pending action for the determination of a FRAND license requires a decision by the panel. From the rapporteur’s perspective, such a decision is best made after an oral hearing. Since oral hearings are already scheduled for the end of November 2024 (EP 132) and the end of January 2025 (EP 163), it seems procedurally efficient, from the rapporteur’s perspective, to decide on the request during or following the already scheduled hearings.”
