Ruby Decor v. Basic Holdings, PI Judge District Court The Hague, the Netherlands, 9 August 2016, Case No. ECLI:NL:RBDHA:2016:9395, with thanks to Alexander Tsoutsanis and Matthijs Schonewille, DLA Piper, for sending in the judgment, a head note as well as an English translation

** Now including an English translation **

Enforcement dispute following the earlier Ruby Decor decision (which may be read here).

Ruby c.s. seek an order prohibiting patentee Basic Holdings from executing the earlier obtained cross-border injunction against three new configurations of the contested product. The PI Judge states that Ruby c.s. is effectively seeking a declaration of non-infringement. In line with Basic Holdings’ defence, the Court dismisses the claims for lack of (urgent) interest, ordering Ruby c.s. to pay full legal costs.
