Philips holds various patents in the field of UMTS technology, amongst which EP 659. In first instance, Philips tried to obtain an injunction against Asus, but the Court agreed with Asus that various claims of EP 659 lacked novelty and/or inventive step and revoked the Patent in Asus’ counter claim.

The Court of Appeal now confirms the judgment in first instance.
