Hologic, Inc. v. Siemens Healthineers AG, Siemens Healthcare GmbH, Siemens Healthineers Nederland B.V., and Siemens Healthcare SAS, UPC CFI LD Düsseldorf, 10 June 2026, Case nos. UPC_CFI_758/2024 & UPC_CFI_259/2025
The UPC Düsseldorf Local Division granted U.S. medical technology company Hologic a permanent injunction in three EU member states, combined with recall and destruction orders against several Siemens Healthineers entities.
The parties argued about the infringement and validity of EP 2 352 431 B1. The patent relates to a “method and system for controlling x-ray focal spot characteristics for tomosynthesis and mammography imaging”
The Court held that Siemens Healthineers’ 3D mammography system “MAMMOMAT B.brilliant” infringes Hologic’s patent. Siemens’ counterclaim seeking revocation of the patent was rejected in full.
The Court also held that Hologic had a legitimate interest in the publication of the decision (Art. 80 UPCA) since Siemens has marketed the attacked embodiment by explicitly referencing to the key technology protected by the patent.
