UERAN Technology LLC v. Xiaomi Corporation ao, Munich Local Division, 24 February 2026, UPC_CFI_609/2025
This decision concerns an application regarding access to confidential documents pursuant to a confidentiality club. The defendants asked the court to restrict access to the lawyer representatives registered in the UPC’s electronic system and to refuse access to this information by the patent attorneys who had been instructed by the claimant.
The court held that Art. 48 UPCA entitled a party to be represented by lawyers and/or patent attorneys and that neither Art. 48 nor Art. 58 (protection of confidential information) implied that this right could be restricted with regard to whether the representative had a more legal or more technical background.
Both types of representative were to be treated equally.
